NEW CONSTRUCTION ACT

#136New Construction Act

The Government of the Slovak Republic has approved a draft of a new Construction Act, which should come into effect on April 1st, 2025. The main objective of the new Construction Act is mainly to reduce the administrative burden on doing business, professionalize the state construction administration, and simplify the construction procedure itself, especially for family houses and small apartment buildings.

The new Construction Act also addresses the issue of so-called "black constructions", the reduced level of discipline in construction, and at the same time repeals the Construction Act No. 201/2022 and the amendment to the Construction Act No. 50/1976 of 2024. The Ministry of Transport of the Slovak Republic is also preparing a new so-called "collective act", which will include all changes in more than 70 acts affected by the new legislation.

The most significant changes in the new Construction Act are:

  1. Expansion of the range of simple constructions that can be permitted in a single administrative procedure and that the builder can secure on his own.
  2. Introduction of a new definition of minor constructions and building modifications, which will no longer have to be reported, except in cases where these constructions are located in a public space or within 2 meters of the border with an adjacent plot of land.
  3. The agenda of the building office at the first instance remains with the municipalities, the appeal bodies are the regional offices of the Office for Spatial Planning and Construction of the Slovak Republic, and the special building offices remain intact.
  4. Stopping duplicative expression and the related abandonment of the two-stage assessment of construction plans in administrative proceedings, i.e. in zoning proceedings and in construction proceedings.
  5. Introduction of new procedures for illegal constructions, in relation to which certain deadlines are set for additional certification or removal for illegal constructions constructed before the new Construction Act came into effect.
  6. The area of ​​misdemeanors and other administrative offenses is clarified by expanding the circle of sanctioned persons to include construction contractors and persons performing construction supervision.
