NEW PSYCHOACTIVE SUBSTANCES ON THE LIST OF NARCOTIC AND PSYCHOTROPIC SUBSTANCES

#115New psychoactive substances on the list of narcotic and psychotropic substances

A draft law was submitted to the interdepartmental comment procedure, the main ambition of which is to include new psychoactive substances in the list of narcotic and psychotropic substances.

To Annex no. 1 of Act no. 139/1998 Coll. on narcotic substances, it is proposed to add new narcotic and psychotropic substances, HHC, HHC-P and HHC-O. After the addition of new narcotic and psychotropic substances, it will be possible to establish criminal liability for their illegal production, distribution and sale.

In addition to expanding the said list, it is planned:

1. elimination of the obligation to submit a positive opinion of the competent public health authority for putting workspaces into operation when a new decision is issued, as well as the municipality's opinion on the start of the activity;
2. elimination of the obligation for the applicant for the issuance of a permit for the cultivation of poppy seeds to state parcel numbers in the affidavit;
3. that the holder of a permit for the cultivation of sown poppy seeds and hemp should annually include plot numbers in the reporting obligations in addition to the sown areas;
4. establishment the obligation of the applicant to submit a description of the research project in which he justifies the research that he is requesting permission for;
5. establishment that the applicant for the issuance of a permit to grow hemp for research purposes should be subject to stricter criteria in order to be issued a permit. A license to grow cannabis for research purposes can only be issued to an entity that either already holds a license to handle narcotic and psychotropic substances - in the scope of research, teaching or expertise, or must submit the same documents in its application as require when issuing a permit for research, teaching or expert activity.
